RENTER REQUIREMENTS
For legal, insurance, and accounting purposes, the person making the reservation is considered to be the Guest/Lessee. All other persons involved with the rental are considered to be the Guest's invitees, and all discussion regarding reservation, cancellation, and damage policies will be discussed with the Guest, not the Guest's invitees. The Guest understands that Durango Red Cliff Properties, LLC rents to responsible adults over the age of 24 ONLY.
RESERVATION AND PAYMENTS
A completed Vacation Rental Agreement is required within 48 hours to complete your reservation. The first half of the total amount due is charged upon booking. The remaining balance is charged 30 days prior to your arrival. If your arrival is within 30 days the full payment is charged upon booking.
All taxes are at the rates applicable at the time of the Rental Agreement. Tax rates are subject to change without notice and any increases will be the responsibility of the Renter. Renter will be notified prior to any additional charges should the tax rate change prior to your stay.
CANCELLATION AND REFUNDS
Cancellations made within 30 days of arrival will forfeit all payments minus the cleaning fee and security deposit. Cancellations made 31 days or more prior to arrival will be refunded in full. Cancellations must be confirmed via email. You are responsible for all of the nights you reserve regardless of your date of arrival or departure. Renters agree that Durango Red Cliff Properties, LLC is not liable if any owner of a property contracted for removes their property from the rental program. Durango Red Cliff Properties, LLC will make every effort to relocate the renter to a comparable property available. If comparable properties are not available, the renter will receive a full refund of fees.
To protect against cancellations caused by certain unforeseen events, such as illness, death, natural disasters, etc., we HIGHLY recommend that guests purchase Trip Cancellation and Interruption Protection insurance to assure refund of deposits paid and reimbursement of other vacation payments. Such insurance is available through several independent sites, auto clubs such as AAA, or online at such companies as http://www.rentalguardian.com or http://www.csatravelprotection.com.
ARRIVAL INSTRUCTIONS
Directions to the unit and other information will be provided upon receipt of your final payment and sent to the email address on file.
CHECK-IN/CHECK-OUT
Check-In is 4:00 PM and Check-Out is 10:00 AM.
SMOKING
All units are non-smoking anywhere on the property. This includes tobacco, marijuana, and vapor devices/e-cigarettes. Any evidence of smoking will result in the full loss of your deposit and/or you could be evicted.
FIRES
Open fires are not allowed at our properties due to the extreme risk of wild fires in our area. Please only use designated gas fire pits or heaters if available at the home.
WINTER CONDITIONS
It is always recommended and may be required on some units that you have 4 wheel drive, all-wheel drive, and/or chains in winter. This is required for all vehicles that will be at the property. Without it you may not be able to access certain areas or properties, especially during or after a snow storm. We will attempt to have the driveway and walkways clear of snow before your arrival. A shovel is provided should you need it during your stay. Please be cautious when there are icy conditions. DRIVE SLOW. Should you enter an area without 4 wheel drive where it is required you will forfeit your deposit, no exceptions. This also applies if you are blocking the road so that it is an inconvenience to others in the development. Do not block entrances to development, mail boxes, driveways or dumpsters as the fine will be enforced. Do not leave cars, trucks, shovels, sleds or anything else in the road as it could block or damage snowplows, neighbor's vehicles and/or limit access in and out of certain areas. Should there be any disrespectful behavior (speeding, damage to property and/or road) from any one in your group we reserve the right to withhold or forfeit your deposit which will go to the parties that incurred the damages. Sledding is prohibited on roads due to the inability of vehicles to stop in winter conditions.
Please note that 4 wheel drive vehicles equipped with snow tires or chains are not available for rent at the Durango Airport rental companies.
OCCUPANCY
Rental of our contracted units DOES NOT entitle guests to use the home for parties, gatherings or any other functions. Any additional day guests must be pre-approved. Properties are private residences and guests agree to use the vacation rental only for their own private use. Violators will be asked to leave with loss of all rental fees and security deposits. Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check in. If any unauthorized guests are found you will be asked to leave without a refund of any fees. Use of the rental does not include space or hookups for motor homes, trailers, or RVs. Any motor homes, trailers, or RVs must be pre-approved with management. Trailers, RV's, or Motor homes over 20 feet long may not be permitted.
PET POLICIES
Pets are allowed in certain units only with pre-approved restrictions and a non-refundable fee. If you are renting a unit with pets please see the additional pet addendum for all rules. This contract will be sent to you in a separate email. If any unauthorized pets are found you will forfeit your full deposit and can be asked to leave without a refund of any fees.
OUTDOOR CAMERAS
Please be advised that some properties have outside cameras, ring doorbells, or wildlife cameras. They are in place to alert owners who live out of state of wildlife issues or wildfires. No cameras are allowed inside the home or have views of the interior of the home.
CLEANING FEES
Renters agree to maintain cleanliness of the home during their stay and leave the home in a reasonably clean condition when they leave. Regular exit cleaning will be done by Durango Red Cliff Properties, LLC and is covered by the exit cleaning fee paid with the reservation. This fee is for our housekeepers who dust, vacuum, sanitize, clean linens and towels, maintain the hot tub and remove refuse from the property. Guests are required to follow all check out procedures provided. Undue and/or unreasonable cleaning of the unit will be deducted from the security deposit. This also applies to the property exterior, grounds, and hot tubs (if so equipped). Guests over the maximum capacity of the unit must be pre-approved. Additional cleaning fees will be charged for guests over max capacity. Garbage restrictions are outlined in each home and guests agree to abide by them. Any infractions that lead to additional clean-up will be deducted from the security deposit; including but not limited to leaving garbage outside or in unsecured containers that animals get into. Longer term rentals may arrange for additional cleaning service at an additional charge.
CONDITION OF RENTAL
The property shall be in the same condition upon departure as at check-in. Guest must immediately notify Property Management of any damages or maintenance issues to the unit. Guest shall be liable for all acts of the family, invitees, or other persons invited onto the property. Guest may not sublet or assign this rental agreement. Guest shall be responsible to return all keys and gate or garage door openers upon departure. Guest shall abide by all house rules as provided to Guest.
SECURITY DEPOSIT
A refundable security deposit will be added to your reservation. This will be fully refunded back to your credit card pending no damages are done. Any damages to the home should be reported to DRCP upon guest arrival. Guests agree if there is damage beyond normal wear and tear to carpeting, furniture, linens, towels, equipment or any other property greater than the security deposit, Durango Red Cliff Properties, LLC is authorized to charge the repair/replacement costs on the credit card given. No charges will be made by Red Cliff without notifying the guest's first with a list of damages and their cost. Any excess telephone or television charges, or extra cleaning may also be charged to the credit card number given. These additional charges include collection costs and attorney’s fees.
Deductions can be made for the following reasons: violation of any of the contract agreements; to repair or replace anything that is damaged or missing; to pay any and all amounts due; to replace keys; additional cleaning expense or to clean excessive dirt (i.e. stained carpets, furniture, walls, appliances, excessive trash etc.) and put the unit, and the things in it, in the condition when you moved in. If your deposit is not enough to cover all the damages and costs, you must pay the extra amount, and you authorize us to charge the credit card provided. No charges will be made without first contacting the guest in writing.
TRUST AND SAFETY
The SafelyStay, Inc. Trust and Safety Fee includes up to $5,000 of accidental coverage for contents and property damage and up to $100,000 coverage for accidental bodily injury. Complete terms regarding the Trust and Safety coverage can be found at safely.com/durangoredcliffproperties. Any deductible or minimum claim amount will be the responsibility of the Guest, and will process using the form of payment on file for Guest. Coverage excludes stays over 29 nights.
EVENTS BEYOND OUR CONTROL
Guests agree that Durango Red Cliff Properties, LLC is not liable for events beyond our control including weather, snow conditions, power outages, maintenance issues, etc. No refunds will be given for storms or weather issues. Gravel drives are well maintained however, we highly recommend four wheel drive and/or chains during the snow months for all properties. We do not refund due to road conditions. Guests agree that Durango Red Cliff Properties, LLC personnel may enter the premises at any time in the event of an emergency. Advance notice will be given for normal maintenance or sales inspections. Durango Red Cliff Properties is not responsible for the levels of water in rivers, ponds or creeks at any given time. Water levels may not always be at the same level as shown in photos. Durango Red Cliff properties is not responsible for level of snow at any given time.
EQUIPMENT/FURNISHINGS
Each property owner furnishes its home differently and all are equipped to basic rental purposes including, bed linens, towels, kitchen utensils and starter supplies of paper products and hand/shower soaps. All other supplies desired must be supplied by the guest. Maintenance problems will be addressed in a timely manner. However, the rental rate cannot be adjusted due to any malfunction of equipment which includes TV., VCR, DVD, heating units, hot water heaters, stoves, refrigerators, locks, hot tubs, internet/WiFi, etc.
Durango Red Cliff Properties, LLC is not responsible for the care or maintenance of community amenities such as pools and hot tubs at Purgatory/DMR, Cascade Village, Ferringway Condos. If these amenities go out during your stay Durango Red Cliff Properties is not liable and cannot offer any refunds.
Please only notify the management company, Durango Red Cliff Properties, LLC, with any maintenance issues. Guests will be responsible for any charges incurred by choosing to call anyone other than Durango Red Cliff Properties, LLC.
HOT TUBS/SPAS
If rental property contains a hot tub (spa), Guest is responsible for operating the hot tub in a careful and safe manner. Hot Tubs have been cleaned and disinfected, refilled, chemically treated, and tested prior to your arrival. As the hot tub is drained and refilled prior to each guest stay, it is possible hot tub water may not reach an optimum level upon guest arrival and may take additional time to reach a comfortable temperature.
UNITS FOR SALE
Some of our rental properties are for sale, and while we try to work around the rental schedule, showings to potential buyers may occur during a renter’s stay.
LANDSCAPING/SNOW REMOVAL
While we try our best to work around the rental schedule, you may encounter landscaping/lawn maintenance during your stay including yard work and snow removal.
THEFT OF SERVICES
If Lessee protests any credit card charges any time before or after their stay, lessee will be reported to the local authorities for theft of service. Your deposit plus any charges from the credit card company will be charged to your credit card as well.
DISCLAIMER
Guests agree that Durango Red Cliff Properties, LLC shall not be liable to Renter, Renter’s guests, invitees or any other person for any injury, loss or damage to any person or property on or about the rental premises. Renter shall hold Durango Red Cliff Properties, LLC harmless and indemnified from and against all loss or damage occasioned by use, misuses or abuse of any part of or fixture on the premises, surrounding areas and from or against any omission, neglect or default of the Renter, his/her guests or invitees. The Renter acknowledges that Durango Red Cliff Properties, LLC acting solely in the capacity of Agent for the property owners, assumes no liability there under. Durango Red Cliff Properties,LLC is not liable for any personal items left behind at the home. |
